In March 2025, Mick Patel was arrested and charged with criminal attempt to commit kidnapping, assault, and battery after a brief interaction inside a Walmart in Kennesaw, Georgia. Despite surveillance footage allegedly showing no injury, no use of force, and no attempt to remove the child from his mother’s custody, Patel was incarcerated in Cobb County jail for 47 days following his arrest. “This case is not about a good-faith error,” said Radner, an experienced civil rights attorney. “It raises serious questions about what happens when exculpatory evidence is ignored, and the system continues forward anyway.”

Mahendra “Mick” Patel, a 57-year-old retired engineer and Georgia resident, filed a federal civil rights lawsuit on February 9, 2026, after he was wrongfully arrested, jailed for weeks without bond, and prosecuted for serious felony charges that were ultimately dismissed in 2025. The lawsuit asserts that law enforcement officers and prosecutors ignored clear exculpatory evidence and pursued criminal charges without probable cause, resulting in severe personal, financial, and reputational harm.

Mick Patel Lawsuit Filed - Feb 9, 2026
Attorneys from Milberg and Radner Law Group, in partnership with the Police Brutality Center, filed a federal civil rights lawsuit on behalf of Mick Patel.
Mr. Patel’s federal lawsuit asserts multiple claims, including malicious prosecution, conspiracy to deprive constitutional rights, equal protection violations, and municipal liability for unconstitutional policies and practices. He alleges that the defendants knowingly pursued charges without probable cause and disregarded exculpatory evidence.
The lawsuit seeks compensatory and punitive damages, attorneys’ fees, and other relief for the alleged violations of Mr. Patel’s constitutional rights.
Criminal Charges Against Mr. Patel Dismissed - August 6, 2025
On August 6, 2025, all criminal charges against Mr. Patel were formally dismissed. Despite the dismissal, Mr. Patel’s lawsuit alleges that he continues to suffer lasting harm to his reputation and finances. The alleged harm includes reputational damage from media coverage of his arrest, loss of business opportunities, removal from charitable organizations, and substantial legal expenses incurred in defending against charges that lacked probable cause.
Patel’s Arrest & Criminal Charges - March 24, 2025
On March 21, 2025, Detective James Evan Wallace of the Acworth Police Department obtained an arrest warrant charging Mr. Patel with criminal attempt to commit kidnapping, simple assault, and simple battery.
Mr. Patel’s lawsuit alleges that, at the time the warrant was sought, law enforcement knew or should have known that Walmart surveillance footage existed that contradicted the allegations. Despite this, officers allegedly failed to review or fairly evaluate the video evidence and instead relied almost exclusively on the accuser’s statements.
On March 24, 2025, Mr. Patel was stopped while driving, arrested, handcuffed, and taken into custody. He was transported to the Cobb County Jail and detained without bond.
The Incident Occurs - March 18, 2025
According to the complaint, on March 18, 2025, Mr. Patel went to a Walmart in Cobb County, Georgia, to purchase over-the-counter medication for his elderly mother. While inside the store, he briefly interacted with a woman using a motorized shopping cart, accompanied by her two young children.
As the cart turned into an aisle, it struck a display, and one of the children appeared to be slipping from her lap. Mr. Patel alleges that he instinctively reached out for a brief moment to steady the child and prevent a fall. The interaction was momentary, involved no force, and Mr. Patel immediately walked away, completed his purchase, and left the store. The entire encounter was captured on Walmart’s surveillance cameras.
